How to File a DMCA Takedown Notice

To file a copyright infringement claim, you must send a written notification. Please include all the information detailed below. Your notice should be sent to our designated DMCA agent.

Your DMCA notice must include the following elements:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material on our site that is infringing, along with its precise location (URL).
  • Your contact information: name, address, telephone number, and email address.
  • A statement that you have a good faith belief the use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notice is accurate.
  • A statement, made under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Counter-Notification

If you believe your content was removed by mistake or misidentification, you may submit a counter-notification. This allows us to restore the content, unless the copyright owner seeks a court order. Your counter-notice must also contain specific details.

Your counter-notification must include the following:

  • Your physical or electronic signature.
  • Identification of the material that was removed and its location before removal (URL).
  • A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the federal district court. This applies to the judicial district where your address is located, or if outside the United States, for any judicial district in which Fairport Light House may be found.
  • A statement that you will accept service of process from the person who provided the original DMCA notification.

Repeat Infringer Policy
